Naturalization and Citizenship Issues

An applicant for US citizenship must show that he or she has been a permanent resident for at least five years unless he or she is married to a US citizen or is applying based on qualifying military service.  Each of these three scenarios is considered further below.

Application based on time as a permanent resident.

A lawful permanent resident who has continuously resided in the United States for at least five years, and who has resided in the district where he or she will be applying for at least three months, and who is a person of good moral character, is eligible to apply for naturalization. An Application for naturalization is made on form N-400. after filing the application the applicant will be called for fingerprinting and biometrics city USCIS can run a background check.  The applicant will subsequently be notified of the data time of his or her citizen interview at USCIS offices. the applicant has the right to be represented by an attorney at this interview. At the interview the applicant will be questioned on the contents of his or her application. The applicant will be tested on his or her knowledge of the English language and civics. If the applicant passes these tests and meets the other requirements mentioned above his or her application will be approved and he or she will subsequently be notified of the time and date of the ceremony.

Application based on qualifying military service

An alien lawfully admitted as a permanent resident may apply for naturalization on the basis of military service onto two sections of the law.   The first section INA section 328 allows the applicant to apply if he or she has served one year in the US Armed Forces and has received an honorable discharge. INA section 329 is application made on the basis of qualifying wartime military service. A service member whether or not admitted as a permanent resident, can apply for US citizenship after serving one year in the US Armed Forces during a period of conflict.
